This public offer is an official offer of the Flowers-Sib.ru delivery service (the contractor) to assist the contractor to render services for sale and delivery of flowers and gifts.
1.1.Buyer is any person (individual, corporate, individual entrepreneur), which means to order or has made an order.
1.2. Online Store is the website flowers-sib.ru.
1.3. Order is a properly drawn up application for delivery of flowers or gifts. Each order has a unique number.
1.4. Confirmed order is the order which the buyer transferred money to the contractor by one of possible methods described in the section "How to pay", and received a response from the online store manager that the order can be delivered within the specified time.
1.5. Acceptance of the offer is full and unconditional acceptance of the offer by the buyer by making an order on the website flowers-sib.ru.
1.6. Recipient is the person specified by the buyer and receiving an order.
1.7. Bouquet is flowers, flower compositions, floral baskets, presented on the website flowers-sib.ru.
The seller undertakes to deliver the order to the recipient after receiving payment of the order and order confirmation.
3.1. General terms
3.1.1. The order will be confirmed only after fixing the payment by the contractor and the notification to the customer.
3.1.2. The order cost is determined by the cost of flowers on the site and the cost of delivery of the bouquet in the selected region.
3.1.3. In case of delivery to remote areas and districts delivery price may vary.
3.2.1. . The order is delivered on the day of the order in the presence of flowers and provided that the order is placed and paid before 7.00 p.m. local time of the recipient.
3.2.2. Delivery time is recommended, and the contractor exerts every effort to deliver the flowers at the specified time by the customer.
3.2.3.. In case of failure of delivery to the specified date and time the contractor is obliged to warn the customer.
3.2.4. The order for delivery of flowers at night (from 9.00 p.m. to 9.00 a.m.) should be coordinated with the contractor and paid before 7.00 p.m. local time of the recipient.
3.2.5. If the recipient is not present at the specified time and address in the order, the courier waits for the recipient for 15 minutes. After that, the courier has the right to take a bouquet back to the sale-room, and the customer is obliged to pay for re-delivery.
3.3.1. In case of absence of the recipient at the specified time at the specified address, the contractor reports this information to the customer and reconciles with him a new time and a delivery address. In this case the customer pays for redelivery according to the rates placed on http://flowers-sib.ru/en/delivery/.
3.3.2. Repeated delivery can be carried out only during the first 48 hours after the first delivery.
3.4.1. The order can be canceled only if the bouquet is not made because flowers are perishable.
3.4.2. If the customer changed his mind to send a confirmed (paid) order until the order creation, the contractor undertakes to refund less the charge in the amount of 15% of the total order.
3.4.3. If the order can not be delivered through the fault of the contractor, the contractor makes a refund of 100% of the money received for the order.
3.4.4. A refund is carried out by the same method that the order was paid by.
3.4.5. If it is impossible to carry out redelivery under the paragraph 3.3.2.through the fault of the customer or the recipient, a refund is not carried out as flowers are perishable.
3.4.5. Refunds are performed by a bank which is a partner organization. On average, the money is transferred to the customer's account within 2-3 days.
3.4.6. Failure to provide free services such as free of charge cards, delivery receipts, photos of the bouquet or the recipient cannot be considered the reason for the refund.
3.4.7. The contractor in the absence of flowers of a particular color spectrum for a mixed bouquet (more than 3 kinds of flowers) can change the color of one type of flowers without the customer's consent. This replacement is not a reason for a refund.
4.1. In case where the recipient gets substandard flowers, the recipient or the customer must provide a photo of the bouquet within 12 hours of the receipt.
4.2. Complaints regarding the quality of flowers will not be accepted by the contractor if the recipient of the bouquet produced its independent transportation (for example, the bouquet was delivered to the office).
4.3. Complaints will not be accepted if the mixture of medicines and other "supplements" for the "extension" of the life of the flowers were added into the water of the flowers, as we do not give any guarantees for the additives to the water that were not purchased from us.
5.1. Duties of the contractor
5.1.1. The contractor is obliged to compose the bouquets which are the most similar to the bouquets, paid by the customer.
5.1.2. On request, the contractor is obliged to suspend the execution of the order for an indefinite period if there are more than 24 hours before the delivery and the bouquet is not composed yet.
5.1.3. If the recipient is absent at the specified address, the contractor is obliged to re-deliver the order in accordance with the paragraph 3.3.
5.1.4. The contractor is obliged to make a refund or replacement of the bouquet (at the customer's discretion) within 24 hours if the bouquet turned out to be substandard in accordance with the paragraph.
5.1.5. The contractor is obliged to refund within 24 hours from the moment of receiving the request according to the paragrphs 3.4.2., 3.4.3.
5.1.6. On request, the contractor is obliged to suspend the execution of the order for an indefinite period if there are more than 24 hours before the delivery and the bouquet is not composed yet.
5.1.7. In case of the absence of flowers the contractor is obliged to notify the customer and reconcile on the replacement of flowers or make a refund in accordance with the paragraph 3.4.3. If the customer does not respond, the contractor has the right to replace the flowers for comparable in price and characteristics. If a bouquet is composed from 3 or more types of flowers, and the contractor does not have one type of flowers of the desired color, the contractor can replace it without reconciling.
The customer is obliged to make one hundred percent advance payment for the order not less than 3 hours prior to delivery in accordance with the paragraphs 3.2.1. and 3.2.4.
6.1. This offer becomes effective from the moment of the order registration in the online store and through online store managers.
6.2. By placing an order the buyer certifies that the conditions of this agreement and other terms and conditions specified on the website at the address at the time of conclusion of the contract are accepted without any objection, and consistent with the actual will of the buyer. By placing an order the buyer has understood the terms, words and phrases used in the present contract according to their legal definitions and (or) their construing in accordance with the Russian legislation.
6.3. By placing an order in the online store the customer gives consent to the processing of their personal data (including first name, last name, father's name, address) in accordance with the art.3, art. 9, art. 15 of the Federal Law "About Personal Data" dated 27.07.2006 with a view to the distribution of catalogs, information about promotions and special offers. The customer's consent to the processing of personal data is provided for an unlimited period of its validity.
